A Busselton business owner will face a retrial over two counts of indecently dealing with a minor while under their care and supervision.
During the trial, the business owner faced three counts of the same charge. The jury found him not guilty of one of the charges.
Two complaints related to a young worker who told police that the man had slipped his hand down her top, touching her breast, while she was cleaning a bathroom.
She then recalled a previous occasion when she thought the man touched her in a similar way, but had dismissed it at the time as being accidental. This was the charge on which the jury acquitted the man.
During the trial, it was alleged the employee was asked to clean a bathroom - a task which she had never done before - and that her employer went in to show her what to do.
In a recorded interview played in court, the junior worker claimed her employer pointed at her face and said she was getting pimples, then he slid his hand down her shirt.
She pushed his hand away to stop it from going any further and the man removed his hand.
He then allegedly asked her age, before slipping his hand down her shirt again.
After the man left, the worker took a few moments to compose herself before asking a colleague if she could use the phone. She then called her mother to pick her up.
During that telephone conversation, the junior worker told her mother she felt violated and would explain more when she arrived.
The mother gave evidence she had picked her daughter up and her daughter had then indicated that she had been touched by her employer. She burst into tears.
The police later conducted an interview with the employer, who denied the allegations.
During the trial, the junior worker admitted she did not like working at the business, finding the job stressful.
When she phoned her mother, she did not expect the matter to end up involving police. She had expected to just stop working at the business.
The retrial will take place in Bunbury on September 27.
