WA Court of Appeal judges upheld an appeal which was lodged by the State Solictors Office in response to a Supreme Court ruling which approved a development for a petrol station in Dunsborough’s town centre.
DCSC Pty Ltd, which own the Dunn Bay Road site, applied for the decisions hearing in a bid to stop the appeal from going ahead.
Last month, the State Solicitors Office applied to the Court of Appeal to overturn the Supreme Court decision which gave a green light for the project.
The Dunsborough community have strongly opposed the development after developers bypassed town planning laws by calling the petrol station a convenience store to seek approval for the application.
If would be the third petrol station within 300 metres of each other.
